Take the 20 second debt test

Exploring the ins and outs of a Trust Deed

The emergence of trust deeds in Scotland has certainly coincided with the financial problems stemming from the credit crunch and more and more people each year opt to make use of a trust deed north of the border. In many ways, a trust deed is similar to an IVA in the UK and the end result will see the individual in question free from debt without any of the negative implications of bankruptcy. A trust deed is set up by an insolvency practitioner and will see an accord reached between the creditors and those in arrears about how much of the debt they can afford to repay. Once an agreement can be reached on how much of the arrears is acceptable to creditors, the trust deed will be initiated and the individual will embark on monthly repayments until their debt has been cleared. In most cases, an individual in Scotland can become debt free in as little as three years through the use of a trust deed and many will find that the overall amount that they have to repay is dramatically reduced.

Trust Deed – Protection from Creditors

If, as it usually the case, at least two thirds of your creditors agree to the trust deed, it becomes a protected trust deed which means that they can no longer pressure you for payment and so forth. A trust deed is an extremely viable option for those with considerable debts and if you think a trust deed might be right for you, it is a good idea to speak to a financial specialist in the field.
